1. What the Service is — and is not
The Service is browser-based software that helps you generate printable copies of IRS Form 1099-NEC (Copy B for the recipient and Copy 2 for the recipient's state filing). It runs entirely in your browser.
The Service is NOT:
- Tax advice, accounting advice, or legal advice.
- A substitute for a Certified Public Accountant ("CPA"), Enrolled Agent, or tax attorney.
- An IRS-authorized e-file transmitter. The Service does not transmit any form to the IRS or any state taxing authority.
- A producer of Form 1099-NEC Copy A. Copy A must be printed on official red-ink scannable IRS forms or filed electronically through an authorized transmitter; the Service does neither.
- Affiliated with, endorsed by, certified by, or guaranteed by the Internal Revenue Service or any state taxing authority.
2. Your responsibilities
You are solely responsible for, and accept full liability for:
- The accuracy of every value you enter into the Service — including but not limited to payer name, payer Taxpayer Identification Number ("TIN"), recipient name, recipient TIN, payment amounts, box selections, and address information.
- Determining whether you are required to issue a Form 1099-NEC under U.S. federal or state law.
- Choosing the correct boxes and amounts to report.
- Filing Copy A with the Internal Revenue Service by the applicable deadline (typically January 31 following the tax year).
- Filing Copy 1 with the appropriate state taxing authority, where required.
- Distributing Copy B and Copy 2 to each contractor by the applicable deadline.
- Any penalties, interest, audit costs, late-filing fees, or other consequences arising from errors, omissions, or untimeliness in your filings.
- Compliance with all applicable U.S. federal, state, local, and (where applicable) non-U.S. tax laws.
3. No warranty
The Service is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by applicable law, we disclaim all warranties, including without limitation any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, timeliness, and uninterrupted operation.
We do not warrant that the PDFs generated by the Service will be accepted by the Internal Revenue Service, any state taxing authority, any contractor, or any third party. We do not warrant that the Service will be free from errors, defects, security vulnerabilities, or interruptions.
4. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall 1099generator.com, its operators, contributors, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including without limitation IRS or state-imposed penalties, interest, audit costs, late-filing fees, lost profits, lost data, business interruption, or reputational harm — arising out of or relating to your use of, or inability to use, the Service, even if advised of the possibility of such damages.
In any case, our aggregate liability to you for all claims arising out of or relating to the Service, whether in contract, tort, or otherwise, shall not exceed the amount you actually paid for the Service in the twelve (12) months preceding the event giving rise to the claim, or fifty U.S. dollars (US$50), whichever is less.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, the foregoing limitations apply to the maximum extent permitted by law.
5. Indemnification
You agree to defend, indemnify, and hold harmless 1099generator.com, its operators, contributors, and affiliates from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Service;
- The accuracy, completeness, or timeliness of any information you enter into the Service or any document generated using the Service;
- Any filing, distribution, or representation you make to the Internal Revenue Service, any state taxing authority, any contractor, or any other third party in connection with output from the Service;
- Your violation of these Terms or of any applicable law.
6. License grant
Upon purchase of a valid license key through our authorized payment processor, you are granted a limited, personal, non-exclusive, non-transferable, non-sublicensable license to use the Service for the tax year identified at the time of purchase, for your own internal business or personal record-keeping purposes. You may not resell, redistribute, sublicense, or share access to the Service. Misuse of license keys may result in revocation without refund.
7. Refund policy
Refunds are handled through our payment processor, Gumroad, under their standard 30-day money-back policy, unless a longer period is required by applicable consumer-protection law in your jurisdiction. To request a refund, contact contact@1099generator.com or use Gumroad's in-platform refund flow.
8. Privacy
The Service runs entirely in your browser; your tax data is not collected, stored, or transmitted by us. See our Privacy Policy for full detail.
9. Governing law and jurisdiction
These Terms are governed by the laws of the Slovak Republic, excluding its conflict-of-laws rules. The courts of Bratislava, Slovak Republic, shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, subject to mandatory consumer-protection rights you may have under the laws of your country of residence (including, without limitation, applicable European Union consumer law or U.S. state consumer-protection statutes) which cannot be derogated from by contract.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date at the top of this page. Continued use of the Service after a change constitutes acceptance of the revised Terms. We will not retroactively expand your obligations or reduce your rights without notice.
11. Miscellaneous
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us with respect to the Service.
No waiver. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
Assignment. You may not assign or transfer your rights under these Terms. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
